The use of our website is generally possible without providing personal data. Name, address or e-mail addresses are collected on our pages only on a voluntary basis, via contact form with your explicit consent in each case. This data will not be passed on to third parties without your express consent.

When accessing the Internet offer, the following information is stored in a log file on the web or application server:

  • IP address of the computer from which the request was sent, see also the separate note on IP addresses below,
  • Browser information (web browser used, operating system, language setting, etc.),
  • Information about the server service used,

We are not able to assign IP addresses to a specific person ourselves or through contractual relationships with third parties; this would only be possible for us by legal means, e.g. by court order for disclosure in the case of criminal charges. Nevertheless, according to recent case law (ECJ, BGH), IP addresses are also classified as personal data.

Upon request, we will be happy to provide you with information as to whether and, if so, what personal data we have stored about you. We will of course comply with requests for correction or deletion immediately. To do so, please send an e-mail to: datenschutzbeauftragter[at]niedax-group.com

Google Tag Manager

We use the service called Google Tag Manager from Google. "Google" is a group of companies and consists of Google Ireland Ltd (provider of the service), Gordon House, Barrow Street, Dublin 4, Ireland as well as Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA and other affiliated companies of Google LLC.

We have concluded an order processing agreement with Google. The Google Tag Manager is an auxiliary service and processes personal data itself only for technically necessary purposes. The Google Tag Manager takes care of loading other components, which in turn may collect data. The Google Tag Manager does not access this data.

For more information on the Google Tag Manager, please refer to Google's privacy policy.

Please note that American authorities, such as intelligence agencies, could potentially gain access to personal data that is inevitably exchanged with Google due to the Internet Protocol (TCP) when this service is integrated, due to American laws such as the Cloud Act.

Google Analytics, other cookies

If you have given your consent, this website uses Google Analytics 4, a web analytics service provided by Google LLC. The responsible party for users in the EU/EEA and Switzerland is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google").

Scope of processing
Google Analytics uses cookies that enable an analysis of your use of our websites. The information collected by means of the cookies about your use of this website is generally transferred to a Google server in the USA and stored there.

We use the User ID function. User ID allows us to assign a unique, persistent ID to one or more sessions (and the activities within those sessions) and to analyze user behavior across devices.

We use Google Signals. This allows Google Analytics to collect additional information about users who have personalized ads enabled (interests and demographics) and ads can be delivered to these users in cross-device remarketing campaigns.

Google Analytics 4 has IP address anonymization enabled by default. Due to IP anonymization, your IP address will be shortened by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. According to Google, the IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

During your website visit, your user behavior is recorded in the form of "events". Events can be:

Page views

First visit to the website

Start of session

Your "click path", interaction with the website

Scrolls (whenever a user scrolls to the bottom of the page (90%))

clicks on external links

internal search queries

interaction with videos

file downloads

seen / clicked ads

language settings

Also recorded:

Your approximate location (region)

your IP address (in shortened form)

technical information about your browser and the end devices you use (e.g. language setting, screen resolution)

your internet service provider

the referrer URL (via which website/advertising medium you came to this website)

Purposes of processing
On behalf of the operator of this website, Google will use this information to evaluate your [pseudonymous [NOT WHEN USING USER ID]] use of the website and to compile reports on website activity. The reports provided by Google Analytics serve to analyse the performance of our website and the success of our marketing campaigns.

Recipients
Recipients of the data are/may be:

Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (as processor under Art. 28 DSGVO).

Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA

Alphabet Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA

It cannot be ruled out that US authorities may access the data stored by Google.

Third country transfer
Insofar as data is processed outside the EU/EEA and there is no level of data protection corresponding to the European standard, we have concluded EU standard contractual clauses with the service provider to establish an appropriate level of data protection. The parent company of Google Ireland, Google LLC, is based in California, USA. A transfer of data to the USA and access by US authorities to the data stored by Google cannot be ruled out. The USA is currently considered a third country from a data protection perspective. You do not have the same rights there as within the EU/EEA. You may not be entitled to any legal remedies against access by authorities.

Duration of storage
The data sent by us and linked to cookies are automatically deleted after 14 months. The deletion of data whose retention period has been reached occurs automatically once a month.

Legal basis
The legal basis for this data processing is your consent pursuant to Art.6 para.1 p.1 lit. a GDPR.

Revocation
You can revoke your consent at any time with effect for the future by accessing the cookie settings by clicking the "lock" icon at the bottom left of the screen and changing your selection there. The lawfulness of the processing carried out on the basis of the consent until the revocation remains unaffected.

You can also prevent the storage of cookies from the outset by setting your browser software accordingly. However, if you configure your browser to reject all cookies, this may result in a restriction of functionalities on this and other websites. In addition, you can prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google, by

a. not giving your consent to the setting of the cookie or
b. downloading and installing the browser add-on to disable Google Analytics HERE.

Google Optimize

We use Google Optimize, a service provided by Google. Google Optimize analyzes the use of different variants of the website, so that we are able to adjust the user experience to fit the behavior of users, for example, by arranging different elements, designs and content.

Google Optimize is a tool embedded in Google Analytics and uses cookies. The incoming IP address is anonymized immediately after processing. In exceptional cases, the entire IP address is transmitted to a Google server in the USA and encrypted there. The transmitted IP address is not merged with other data from Google.

Users can prevent the storage of cookies by setting the browser accordingly. We would like to point out that in this case not all functions of our website can be used to their full extent.

You can also prevent the collection of data generated by cookies and related to your use of the website by Google, as well as the processing of this data by Google, by downloading and installing the following browser plug-in: http://tools.google.com/dlpage/gaoptout?hl=de.

Facebook Pixel, Facebook Custom Audiences and Facebook Conversion

Within our online offer, the so-called "Facebook Pixel" of the social network Facebook, which is operated by Facebook Inc, 1 Hacker Way, Menlo Park, CA 94025, USA, or if you are a resident of the EU, Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"), is used.

With the help of the Facebook pixel, it is possible for Facebook, on the one hand, to determine you as a visitor to our online offer as a target group for the display of advertisements (so-called "Facebook ads"). Accordingly, we use the Facebook pixel to display the Facebook ads placed by us only to those Facebook users who have also shown an interest in our online offer or who have certain characteristics (e.g. interests in certain topics or products determined on the basis of the websites visited) that we transmit to Facebook (so-called "Custom Audiences"). With the help of the Facebook pixel, we also want to ensure that our Facebook ads correspond to the potential interest of users and do not have a harassing effect. With the help of the Facebook pixel, we can further track the effectiveness of the Facebook ads for statistical and market research purposes by seeing whether users were redirected to our website after clicking on a Facebook ad (so-called "conversion").

Privacy policy of Facebook

The processing of data by Facebook takes place within the framework of Facebook's data usage policy. Accordingly, general information on the display of Facebook ads, in the data use policy of Facebook. Specific information and details about the Facebook pixel and how it works can be found in Facebook's help section.

Basis

The use of the Facebook Pixel and the storage of "conversion cookies" is based on Art. 6 (1) lit. a DSGVO.

Order data processing contract

For the processing of data where Facebook acts as an order data processor, we have concluded an order data processing contract with Facebook in which we oblige Facebook to protect our customers' data and not to pass it on to third parties.

Objection

You can object to the collection by the Facebook pixel and use of your data to display Facebook ads. To adjust which types of ads are displayed to you within Facebook, you can visit the page set up by Facebook and follow the instructions there regarding the settings for usage-based advertising.  The settings are done in a platform-independent manner, which means that they are applied to all devices, such as desktop computers or mobile devices. You can further object to the use of cookies that are used for reach measurement and advertising purposes via the deactivation page of the Network Advertising Initiative and additionally the US website aboutads.info or the European website youronlinechoices.com.

In addition, LinkedIn offers the possibility of retargeting via the Insight Tag. We can use this data to display targeted advertising outside our website without identifying you as a website visitor. Use of videos (e.g. YouTube, Vimeo)

Privacy policy due to the use of a YouTube plugin

This website contains at least one plugin from YouTube, belonging to Google Inc, based in San Bruno/California, USA.

We use the YouTube function No-Cookies, i.e. we have activated Enhanced Privacy, videos are not accessed via youtube.com, but via youtube-nocookie.com.

YouTube itself provides this and thus ensures that YouTube does not initially store any cookies on your device. However, when the relevant pages are called up, the IP address and the other data mentioned in section 4 are transmitted and thus, in particular, information is provided as to which of our Internet pages you have visited. However, this information cannot be assigned to you if you are permanently logged in to YouTube or another Google service when you call up the page.

As soon as you start the playback of an embedded video by clicking on it, YouTube only saves cookies on your device through the extended data protection mode, which do not contain any personally identifiable data, unless you are currently logged in to a Google service. These cookies can be prevented by appropriate browser settings and extensions.

Cookies

At the moment when the playback of the embedded video is started, the Youtube uses cookies to collect information about user behavior.

According to information from Youtube, these are used, among other things, to collect video statistics, improve the user experience and prevent abusive behavior.

Independently of a playback of the embedded videos, a connection to the Google network "DoubleClick" is established each time this website is called up, which may trigger further data processing operations without our influence.

In this way, we ensure that the request to receive the newsletter actually comes from you.

We use the software Sendinblue for sending mailing campaigns and newsletters. The provider is Sendinblue GmbH, Köpenicker Straße 126, 10179 Berlin, Germany. Sendinblue is a service with which, among other things, the sending of newsletters can be organized and analyzed.
